  • Appointment of PM
    • No special Provisions for appointment of PM
    • Article 75 says
      • President will appoint PM
      • Majority party candidate need to be appointed
      • If No Majority, Situational discretion in selecting PM
      • Largest Party or Coalition 
        • Prove majority within a month
    • PM dies suddenly : President can appoint : If ruling party appoints new leader, President has no choice but to appoint him as PM
    • SC in 1997
      • A person not a member of either of house of Parliament, if appointed as PM for 6 months
        • Should become member within 6 months
      • PM can be of either of House
        • But in Britain only of Lower house 
  • Oath
      • To bear true faith and allegiance to the Constitution 
      • To uphold the Sovereignty and Integrity of India
        • No unity
      • To faithfully discharge the duties of his House
      • To do right to all manner of people in accordance with the Constitution and law without fear
    • Oath of Secrecy 
  • Term
    • Not fixed
    • Under the Pleasure of President
      • As long as he enjoys Majority in Lok Sabha
    • If he loses confidence, mustresign or President candismiss him
  • Salary and Allowances
    • Determined by Parliament from time to time
    • Gets Sumptuary(Personal) Allowance, Free Accommodation, Travelling Allowance, etc
  • Powers and Functions
    • In relation to Council of Ministers
      • Recommends to the President for appointment of minister
      • Ask a minister resign or advice President to dismiss him
      • Allocate and Reshuffle various portfolios 
      • Guide, direct, control activities of all ministers
      • Can bring collapse of CoM by resigning 
    • In relation to President
      • Communicate all decision of CoM
      • Furnish such information related to administration as President may call for
      • Advise President on important appointments 
    • In relation to Parliament 
      • Advise the President
        • Summoning and Proroguing of session of Parliament 
      • Recommend dissolution of Lok Sabha
      • Announce Government policies on the floor of house
    • Other Powers
      • Chairman of
        • NITI Aayog
        • National Development Council
        • National Integration Council
        • Inter State Council 
        • National Water Resource Council
      • Shaping foreign policies 
      • Chief spokesman of Union Government 
      • Crisis manager in chief during emergencies 
      • Leader of party in Power, etc
