  • 2nd highest position next to President
 
  • Qualification
    • Citizen of India
    • Completed 35 years of age
    • Qualified for member of Rajya Sabha
    • Should not hold any office of Profit 
    • At least 20 proposers and 20 seconders
    • 15000 deposit in RBI
  • Election    
    • Who can vote
      • Member of Lok Sabha
        • Anglo Indian nominated can vote
      • Member of Rajya Sabha
        • Nominated members can vote
      • Members of Legislative Assemblies can’t vote
    • Proportional representation 
    • Single transferable vote 
    • Indirect Election
  • Oath or Affirmation
      • To bear true faith and allegiance to the constitution of India
      • To faithfully discharge the duties of his office 
    • Administered by President or some person appointed in that behalf by him
  • Conditions
    • Shouldn’t be a member of either house of Parliament or State legislature 
    • Shouldn’t hold any office of Profit
  • Term
    • 5 years from the date he enters upon his office
    • Can resign to the President 
    • Can be removed
    • Can hold beyond 5 years until successor assume charge
    • Can be elected any number of times
  • Removal 
    • Resolution of Rajya Sabha passed by Effective Majority, Simple Majority in Lok Sabha
    • 14 days advanced notice
  • Vacancy
    • Expiry of his tenure : 5 years
      • Election to fill the vacancy must be held before the expiration of the term
      • In case of delay in election, he continues until his successor 
    • Resignation 
    • Removal 
    • Death 
    • In case of Resignation, Impeachment, Death
      • Election should be held as soon as possible
      • Newly elected Vice President remains in office for 5 years
  • Election disputes
    • SC decision is final
    • Election of a person as Vice President can’t be challenged on the ground that electoral college was incomplete
    • If the election of person as Vice President is declared as void, Acts done by him before the date of such declaration of SC are not invalidated
  • Powers and Functions
    • Acts a ex-officio chairman of Rajya Sabha
    • Similar to that of Speaker of Lok Sabha
    • Similarly, American VP acts as Chairman of Senate
    • Acts as a President during vacancy due to Resignation or Death for maximum of 6 months
      • In US, VP acts as a President for the completion of term
    • While acting as President, VP doesn’t perform as a Chairman of Rajya Sabha
  • Emoluments 
    • Not fixed
    • Draws regularly salary in his capacity as Chairman of Rajya Sabha
